Student(s) and parent(s)/legal guardian(s) may appeal any disciplinary action resulting in a suspension of more than three (3) days to the school principal. Suspensions of more than four days up to a total of nine days may be appealed to the Executive Director for that school. Long-term suspension or expulsion may be appealed to the Atlanta Board of Education (“Board”) through the Superintendent.The Appeal to the Board must be in writing and sent to the Superintendent within twenty (20) calendar days of the date of the decision. The Appeal must give specific reasons why the decision is being appealed. Issues not addressed during the Tribunal Hearing will not be heard on appeal. The Appeal must be sent to Dr. Beverly L. Hall, Superintendent, Atlanta Public Schools, 130 Trinity Avenue, Atlanta, Georgia 30303.
Pending the outcome of any appeal, the Superintendent may suspend enforcement of the suspension or expulsion. The Board will not hear oral arguments as part of the appeal. Written arguments concerning the merits of the appeal must be based solely on the record created during the hearing before the Student Disciplinary Tribunal. The Board’s decision will be made within ten (10) working days of the Superintendent’s receipt of the notice of appeal. The Board will consider the appeal in Executive Session and has the power to affirm, reverse, or modify in any respect, the decision reached by the Student Disciplinary Tribunal.
The Board’s decision is final unless an appeal is made to the State Board of Education.The Appeal to the State Board of Education must be in writing and sent to the Superintendent (Kathy Cox) within thirty (30) calendar days of the Board’s decision.
